John.......the 'Failsafe - Trans program'  message may something as simple as a 
low battery. Even though the battery starts the car it may still be low. Check 
battery fluid and have the battery tested. If the battery is OK then have a 
dealer do a diagnostic check to see if the 'Trans Program' fault registered in 
the On Board Computer.

I had this similar problem on a 94 740il I just bought. The battery was dry - 
it took 1.5 quarts of fluid - and the Trans Program message kept coming on when 
I shut the car down.  New battery - no more Trans Program.

Hope this solves your problem and you don't have a Trans problem.
