A couple of relevant factors:

You just bought the car 6 weeks ago, no time to depreciate from your
purchase price.

If the structure of the car has changed (frame?) then the car will no
longer provide the crash protection which it did before. If the other
guys ins co says it's okay, ask them to prove it! Get a BMW structural
rep (from Germany? $$) to inspect the car. Otherwise...

Get a check for $36,000. 

Fight and you will get very close. Ask me how I know.
