parking ticket



not only do you have "a snowball's chance in hell" of getting that ticket
dismissed, but you'd better!  that ticket (the charge) doesn't just omit
some information, it clearly MISidentifies the car in question.  that bmw
is not your car. end of story, simple as that.  just don't phrase it
(your written or verbal argument) with something like "you misidentified
MY car".  remember, the car specified in the ticket is not your car.

of course the only caveat here is that parking tickets are generally
handled administratively - so there don't have to be any of those pesky
legal standards involved.  so everything that governs parking, etc. are
rules not laws; the two are far from synonymous.  therefore the "judge"
can really do anything he wants.  if he doesn't like your mustache 
grooming that day (if you have one of them) he can just find not in your
favor: "not substantial evidence to warrant a dismissal blah blah
blah....".  in administrative "law" the burden is on you.

but my experience is that in the name of keeping up the charade - matlock
style, "judges"  generally try to approximate a real legal environment,
complete with legal arguments and all, ornamental legal precedents and
all.  i have had decent with such tickets (with $55 and $85 nyc tickets
there's little option in my mind about paying/arguing), and on the one
occasion where the "judge" wasn't interested in my argument i won on
appeal.  be confident without being cocky, and maybe even look up the
pertinent parking violation before you go in.
