You may want to check the laws of your state regarding disclosure of
collision damage to subsequent buyers. Some states do in fact impose a
duty on owners to disclose damage to buyers. For example, in North
Carolina, it is a misdemeanor to fail to disclose in writing the fact that
a car has been involved in an accident involving repair costs equal to or
exceeding 25% of its fair market retail value if the car in question is
less than 5 model years old.
If California has a similar law which applies to your situation, then of
course the rationale for AAA's exclusion goes out the window and you can
argue that you are required to disclose the damage and will suffer further
loss as a result. Check with an attorney in your area who handles motor
vehicle negligence cases - they should be able to provide a fairly quick
and concise answer.
