Any car that pops out of gear is due for a new/rebuilt transmission.
First test I do with a used car is back up with car in reverse and rapidly
let
of the gas to see if the transmission will stay in gear (old british car
test thats applicable to many cars).

BMW has had this problem for quite some time which is evident by at least
2 previous posts on this digest concerning the same thing.

Its under warranty so no worrys.
