88' 535i brake light

my new 88 535i (great 87325i for sale if your near Alberta) has a brake
light thing.  It doesn't come on immediately at start, maybe a block or
so, and stays on consistently.  If I stop, and pump the brakes, it goes
off, but then comes back on even if I keep pressure.

I haven't been able to feel them as "spongy, soft, or hard then soft"
they just feel ok, mind you I've only had it 2 days.

Dealer put on new pads and checked sensors in May.  Any thoughts on
this?
