Paul,
Any agreement whether verbal or written is a contract. The dealer
cannot then sell the car from under you.
I'd suggest getting a written contract and there is no need to pay more
than MSRP.
Here in Ottawa, both dealers are excellent (especially the one I dealt
with - no names here). Z3s were sold as agreed despite the fact that
one purchaser turned around and sold his two days later for $5000 more
after having driven it off the lot. Cars were sold out by January with
delivery first taking place starting April.
Fight for your rights, get it in writing and make a lot of loud
complaints. There are lots of interested parties who have a vested
interest in ensuring dealers maintain a level of integrity etc.
Never go back to the dealer who screwed you. In fact, I'd also suggest
informing him of every stage in your new purchase, so he can be aware of
his lostv opportunity on a regular basis.
