Your '99 car must be an E46. In the US it would still be under warranty. 
If it's the same case in UK, take it to the dealer.
On E36 cars this behavior would be associated with a flaky fuel level 
sender. BMW NA blamed it on the high sulphur US fuel and came up with 
multiple iteration of upgraded senders. Long story short, the only long 
term fix is to replace the sender.
For whatever reasons, the failure would be precipitated by fueling the car 
with either ignition turned on or the key just in the ignition lock. Could 
be only a correlation.
